1. About Bargo

Bargo is an Australian grocery price comparison app developed and operated by Christian Biehl (ABN: 91 523 719 179), trading as Biehl Digital, Canberra ACT, Australia ("we", "us", "our").

Bargo helps Australians find the best prices for grocery and household products across a wide range of retailers. By using Bargo, you agree to these Terms and Conditions ("Terms"). Please read them carefully.

These Terms apply to the Bargo mobile app (iOS and Android) and web application, accessible at bargo.au.

2. What Bargo Is — and Is Not

2.1 A price comparison service

Bargo is a price comparison and shopping planning service. We display product prices sourced from publicly available retailer websites to help you make informed purchasing decisions.

Bargo is not a retailer. We do not sell products, process payments for purchases, hold stock, or fulfil orders. All purchases are made directly with the relevant retailer and are subject to that retailer's own terms, pricing, availability, and policies.

2.2 Basket handoff model

Where Bargo provides links or directions to a retailer's website or app to complete a purchase, Bargo's role ends at that point. We are not a party to any transaction between you and a retailer. Any dispute about a purchase, product quality, delivery, or fulfilment must be directed to the retailer concerned.

2.3 Age-restricted products

Bargo displays prices for products that are subject to age restrictions under Australian law, including alcohol. Displaying the price of an age-restricted product does not constitute an offer to sell that product. The retailer is solely responsible for verifying your age before completing any sale. You must comply with all applicable laws regarding the purchase of age-restricted products in your state or territory.

Bottle shop pricing — in-app age verification: To access pricing from bottle shops (Dan Murphy's, BWS, Liquorland, and Cellarbrations) or to add alcohol products to your shopping list or price alerts, you must confirm that you are 18 years of age or older. This confirmation is presented as a one-time prompt within the App. By tapping "Yes, I'm 18 or older", you:

Age confirmation is self-declared and stored as a preference against your account. We do not verify age through any third-party identity verification service. If we become aware that a person under 18 has provided age confirmation, we will revoke that status and restrict access to alcohol-related pricing.

2.4 Household sharing

Household sharing is available on paid subscription tiers. The following conditions apply:

3. Price Data — Accuracy and Limitations

3.1 How we collect prices

Bargo retrieves prices from retailer websites and APIs multiple times per week. Update frequency varies by retailer. We display the most recently confirmed price for each product alongside the date and time it was last verified.

3.2 Prices may not be real-time

Prices are updated multiple times per week, but update frequency varies by retailer. Some retailers actively restrict automated price lookups, which may mean certain prices are not updated as frequently as others. Bargo always displays the date and time each price was last verified so you can assess its freshness.

Bargo makes no representation that a price displayed in the app is the current price at any particular store at the time you visit. Always confirm the price with the retailer before purchasing.

3.3 Store pricing — national chains vs independent retailers

Woolworths, Coles, and Aldi operate nationally consistent pricing — the price for a given product is the same across all of their standard stores nationally. Bargo shows a single national price for these retailers.

Woolworths store formats: Woolworths operates stores in several formats. Standard supermarkets carry the full product range at national prices. Metro stores — typically smaller stores located in CBDs, transport hubs, and inner-suburban shopping centres — may charge different prices from the standard national price for some products. Woolworths also operates convenience-format stores co-located within EG Ampol service stations, which carry a limited range at convenience pricing. Bargo shows prices based on the standard Woolworths supermarket catalogue. Woolworths EG Ampol service station locations are not covered by Bargo.

Coles store formats: Coles Express service station locations operate under a separate convenience pricing structure and carry a limited range. Coles Express locations are not covered by Bargo.

Even within a national chain, not every product is stocked at every store. Bargo shows prices for all products listed by a retailer nationally; it cannot tell you whether a specific product is on the shelf at your specific store.

IGA and Harris Farm are independently operated stores where prices vary by location — sometimes significantly. The same product may cost noticeably more or less depending on which store you visit. If you have enabled location services, Bargo will show prices from the store nearest to you. If location is not enabled, Bargo will show a representative price which may not reflect your local store exactly. IGA prices in particular can vary by more than 20% between stores for the same product.

Cellarbrations operates approximately 520 stores nationally, with pricing set independently at each store. Bargo currently shows prices from a representative selection of Cellarbrations locations — one store per state and territory — chosen to reflect typical pricing within each region. These prices are provided as a useful guide and may not reflect the exact price at your nearest Cellarbrations store. We intend to expand Cellarbrations coverage over time.

3.4 Specials and promotions

Bargo displays special or promotional prices where these are available through the retailer's public-facing data. We cannot guarantee that a promotion shown in the app is still active at the time of your visit to the store. Always check with the retailer for current promotional pricing.

3.5 No liability for pricing errors

Bargo does not guarantee the accuracy, completeness, or currency of any price data displayed. To the fullest extent permitted by Australian law, Biehl Digital accepts no liability for any loss or inconvenience arising from a user acting on pricing information displayed in the app that is inaccurate, outdated, or no longer available.

3.6 Unit pricing

Where a retailer does not provide unit pricing directly (price per 100g, per 100ml, etc.), Bargo calculates an approximate unit price from the product name and declared size information. Calculated unit prices are clearly marked with a ~ (tilde) symbol in the App. These figures are provided as a convenience only and may differ from the unit price displayed in-store or on the retailer's website. Bargo accepts no liability for any decision made on the basis of a calculated unit price.

Harris Farm Markets does not provide unit pricing through its public product data. All Harris Farm unit prices displayed in Bargo are calculated figures and will always appear with the ~ symbol. The ACCC's unit pricing rules require unit pricing to be displayed by supermarkets with a floor area over 1,000m² — Harris Farm's public-facing digital data does not currently include this information, and Bargo's calculated figures are provided on a best-efforts basis only.

4. Your Account

4.1 Creating an account

To use certain features of Bargo you must create an account. You must be at least 13 years of age to create an account. Users under 18 may use all core grocery comparison features, but access to alcohol pricing from bottle shops requires a separate age confirmation (see §2.3). By creating an account, you confirm that the information you provide is accurate and complete.

4.2 Your responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you suspect unauthorised access to your account, please contact us immediately via bargo.au/contact.

4.3 One account per person

Each account is for individual use. You must not share your account with others or create multiple accounts for the same person. Household sharing features are available on paid tiers and allow multiple people to access a shared household list under a single subscription.

4.4 Account suspension and termination

We reserve the right to suspend or terminate your account if you breach these Terms, engage in behaviour that is harmful to other users or to Bargo, or if your account has been inactive for an extended period (refer to our Privacy Policy for details of our inactivity policy).

4.5 Account deletion

You may delete your account at any time directly within the App via Account → Settings → Delete Account, or by contacting us at contact@bargo.au. Upon deletion, your personal data will be deleted or anonymised within 30 days as described in our Privacy Policy. Account deletion is permanent and cannot be undone. Any remaining subscription period at the time of deletion is non-refundable except where required by Australian law.

5. Subscriptions and Billing

5.1 Free tier

Bargo offers a free tier that provides access to core price comparison features at no cost. No credit card is required for the free tier. The free tier is supported by subscription revenue, not advertising — Bargo displays no advertisements at any tier.

5.2 Paid subscriptions

Bargo offers paid subscription tiers that unlock additional features. Current pricing is displayed in the app. Prices are in Australian dollars and include GST where applicable.

Subscriptions are billed on a monthly basis and renew automatically unless cancelled. By subscribing, you authorise us (or our payment processor) to charge your nominated payment method on a recurring basis until you cancel.

Subscription auto-renewal notice: Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your payment method will be charged within 24 hours prior to the end of the current period. You can manage and cancel your subscription at any time in your App Store or Google Play account settings.

5.3 Payment processing

Subscription payments are processed by Apple (App Store) or Google (Google Play) depending on your platform. Bargo does not directly store or handle your payment card details. The applicable platform's terms and privacy policy govern payment processing. Users wishing to subscribe via the web at bargo.au will be directed to their preferred app store to complete their subscription.

5.4 Cancellation

You may cancel your subscription at any time through the App Store, Google Play, or your Bargo account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until that date. We do not provide refunds for partial billing periods unless required by law.

5.5 Price changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price increase. If you do not wish to continue at the new price, you may cancel before the change takes effect.

5.6 Founding beta testers

Users who participated in Bargo's founding beta testing program prior to public launch, and who were granted lifetime free access, are exempt from subscription requirements for the duration of that grant. This benefit is personal to the individual and is not transferable.

5.7 Platform terms — Apple App Store and Google Play

Apple App Store: If you download Bargo from the Apple App Store, your use of the App is also subject to Apple's standard Licensed Application End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of any conflict between these Terms and Apple's EULA, Apple's EULA prevails only to the extent required by Apple. Apple Inc. is a third-party beneficiary of these Terms with respect to your use of the App, and Apple has the right to enforce these Terms against you as a third-party beneficiary thereof.

Google Play: If you download Bargo from Google Play, your use of the App is also subject to Google Play's Terms of Service, available at play.google.com/about/play-terms.

Bargo is not sold to you by Apple or Google. Apple and Google are not responsible for the App or its content, maintenance, support, or any warranty claims. Any claims relating to the App — including product liability, legal compliance, or consumer protection claims — must be directed to Biehl Digital, not to Apple or Google.

6. Acceptable Use

6.1 Permitted use

Bargo is provided for your personal, non-commercial use. You may use the app to compare prices, manage shopping lists, and plan grocery purchases for yourself and your household.

6.2 Prohibited use

If you have a complaint about Bargo or our handling of your personal information, please contact us at contact@bargo.au or via the contact form at bargo.au/contact. We aim to acknowledge all complaints within 5 business days and to resolve them within 14 business days. If you are not satisfied with our response, you may contact the relevant consumer protection authority in your state or territory, or the Australian Competition and Consumer Commission (ACCC) at accc.gov.au.

7. Intellectual Property

The Bargo app, its design, code, content, branding, and all associated materials are the property of Biehl Digital. Nothing in these Terms transfers any ownership of intellectual property to you.

Price data displayed in Bargo is sourced from publicly available retailer information. Product names, images, and trademarks belong to their respective retailers and brand owners.

You retain ownership of any content you create within Bargo, such as shopping lists and notes. By using Bargo, you grant us a limited licence to store and process that content for the purpose of providing the service to you.

8. Disclaimers and Limitation of Liability

8.1 Service provided as-is

Bargo is provided on an "as is" and "as available" basis. We do not warrant that the app will be uninterrupted, error-free, or that any defects will be corrected. We reserve the right to modify, suspend, or discontinue any part of the service at any time. Where we make a material change — such as removing a supported store or a core feature — we will endeavour to provide at least 14 days’ notice via the app or email.

8.2 Limitation of liability

To the fullest extent permitted by Australian law, Biehl Digital's total liability to you for any claim arising from your use of Bargo is limited to the amount you paid for your subscription in the 12 months preceding the claim. Biehl Digital is not liable for any indirect, incidental, special, or consequential loss or damage.

8.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable consumer protection legislation that cannot be excluded by agreement. Our liability for a failure to comply with a consumer guarantee is limited as permitted by the Australian Consumer Law.

9. Third-Party Services

Bargo uses a number of third-party services to operate, including Google Firebase (database, authentication, and analytics), Expo (app build, update, and push notification delivery), and Apple or Google for subscription processing. Your use of these third-party services is subject to their respective terms and privacy policies. Bargo is not responsible for the practices of these third parties beyond what is described in our Privacy Policy.

We collect anonymised, aggregated data about how features within the app are used — for example, which features are opened, how frequently, and whether they are used more than once. This data is used solely to improve the app, including identifying features that are rarely used and may be simplified or removed. It is never linked to you individually and is never shared with third parties for commercial purposes.

Links or deep-links to retailer websites are provided for convenience. We have no control over the content, terms, or practices of those websites.

10. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, available at bargo.au/privacy. By using Bargo, you agree to the collection and use of your information as described in that policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or by email. Your continued use of Bargo after any changes constitutes your acceptance of the updated Terms.

The date at the top of this document indicates when it was last updated. We recommend reviewing these Terms periodically.

12. Governing Law

These Terms are governed by the laws of the Australian Capital Territory, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of the Australian Capital Territory, unless otherwise required by applicable law.
